DoD-Led Interagency Report on the Industrial Base and Supply Chain Resiliency

VII. A Blueprint for Action

President Trump’s historic EO 13806 provided DoD and its interagency partners a unique opportunity to assess the manufacturing and defense industrial base – one of the most critical assets to our national security. The work conducted by the over 300 members of the DoD-led Interagency Task Force lays the groundwork for important actions, mitigations, and ongoing monitoring that will result in America’s ability to continue supporting a secure, robust, resilient, and ready industrial base.

Current Efforts

The DoD-led Interagency Task Force recognizes and supports ongoing efforts to address the challenges identified in the EO 13806 assessment, including:
  • Increased near-term DoD budget stability with the passage of the Bipartisan Budget Act of 2018, providing stable funding through FY2019
  • Modernization of the Committee on Foreign Investment in the U.S. and investigations under Section 301 of the Trade Act of 1974 into Chinese intellectual property theft, to better combat Chinese industrial policies targeting American intellectual property
  • Updates to the Conventional Arms Transfer policy and unmanned aerial systems export policy to increase U.S. industrial base competitiveness and strengthen international alliances

    The China Challenge: Economic Sticks and What To Do About Them

    The Senate Foreign Relations Committee is holding a three-part hearing series under the 'Subcommittee on East Asia, The Pacific, and International Cybersecurity Policy' on a topic it calls "The China Challenge." The first hearing "The China Challenge, Part 1: Economic Coercion as Statecraft," was held on July 24, 2018, the second "The China Challenge, Part 2: Security and Military Developments" was held on September 5, 2018 and the third is pending.

    The first hearing was attended by two witnesses, Dan Blumenthal of American Enterprise Insititute (AEI) and Ely Ratner of Center for a New American Security (CNAS). During his testimony, Mr. Ratner presented a report prepared by CNAS titled "China's Use of Coercive Economic Measures." For a better understanding of what is meant by coercive economic measures, here is part of the introduction from Chapter 1 of the report:
    China has long used economic statecraft as a pillar of its foreign policy. Historically, Chinese leaders used economic inducements ranging from gifts to the promise of loans and investments to solidify relationships with foreign governments and advance Chinese influence. [...]

    In 2013, China launched the Belt and Road Initiative (BRI), a potentially $1 trillion, almost 70-country global infrastructure development initiative that is likely to significantly expand Chinese influence from Asia to Europe. [...]

    Over the past decade, however, China has also used the “sharp end” of its economic statecraft, turning to coercive economic measures as a tool. The authors define coercive economic measures as China’s restrictions on trade or investment intended to impose financial or economic costs on a target in pursuit of a foreign policy objective or to influence a foreign government to offer policy concessions to China. As used here, coercion indicates the use, or threatened use, of economic “sticks,” but not the use of positive inducements or other tools, as commonly included in academic definitions.

    Gov's Cyber Performance: 10 Key Metrics

    Performance.gov published the Federal government's Cybersecurity Key Performance Indicator report for Q3 FY 2018. 10 key metrics were measured for 23 agencies.

    Performance.gov was created to fulfill the statutory requirements of the Government Performance and Results Act of 1993 and the GPRA Modernization Act of 2010 legislating the creation of an online performance reporting portal. The portal provides information about the President's Management Agenda (PMA), the Federal performance management framework, and the federal goal-setting process.

    Foreign Political Influence, Manafort, and FARA Enforcement

    FARA, or the Foreign Agents Registration Act, is a law that was originally passed in 1938. It essentially requires that people who represent foreign interests in a political capacity register with the Department of Justice and publicly disclose certain transactions. From the NY Times:
    Lobbyists that register under FARA must report specific meetings, phone calls and other details of contacts with members of Congress or federal officials to the Justice Department, which then posts the material online.
    FARA is administered and enforced by the FARA Registration Unit under the Department of Justice's National Security Division's (NSD) Counterintelligence and Export Control Section (CES).

    Over the course of its enactment, the law has only been lightly enforced, with the emphasis being on voluntary compliance.

    Paul Manafort, Trump’s former campaign chairman, has been the most prominent FARA case to be prosecuted in five decades. During the previous five decades, only 7 people have been criminally charged under the law.

    Manafort has represented the interests of many foreign government and political group clients over his career. In more recent years, he reportedly received $60m from Ukraine oligarchs to help promote their political interests, one of those was helping to bring Ukraine's now former pro-Russian president to office. Though Manafort had been investigated many years before and told to correct his filings under FARA he never did.

    In addition to light enforcement, FARA has some further shortcomings. Again from the NY Times:
    Congress is also considering whether to strengthen the statute. A bill sponsored by Senator Charles E. Grassley, the Iowa Republican who leads the Senate Judiciary Committee, would close a major loophole by requiring lobbyists hired by foreign commercial interests to file FARA reports. 
    Currently, lobbyists representing foreign commercial interests register only with Congress, which requests minimal information, while those who represent foreign “principals” working for the benefit of foreign governments or political parties register with the Justice Department. The dual disclosure regimes create a huge gray area because in many countries, including Russia and Ukraine, the line between commercial and government interests is heavily blurred.
    Some privacy, non-profit, and pro-business groups are opposing the bill saying the original bill is still too vague and needs to be cleaned up before new legislation makes sweeping and possibly politicized investigations easier.

    Due in part to the recent activity with Manafort and Mueller’s Special Counsel investigation, there have been 50% more new FARA registrations this year from last.

    Testimony on Sanctions Programs, Particularly for Iran, Russia, and North Korea

    Marshall Billingslea testified for a Congressional hearing titled “Administration Goals for Major Sanctions Programs” on September 26, 2018.

    His introduction by Congressman Barr details his long history of public service (at 37:35):
    Today we welcome the testimony of Marshall Billingslea who was confirmed in June of 2017 as Assistant Secretary of the Treasury for Terrorist Financing. In this role he helps oversee the Trump administration's efforts in administering economic sanctions programs globally.

    Prior to joining Treasury Mr. Billingsley served as managing director for business intelligence services at Deloitte Advisory. He had previously held positions at the Department of Defense where he served as Deputy Under Secretary of the Navy and Principal Deputy Assistant Secretary of Defense for Special Operations and Low Intensity Conflict.

    Mr. Billingsley has also worked as NATO Assistant Secretary-General for Defense Investment and as a staff member on the Senate Foreign Relations Committee.     CFIUS Updated with Foreign Investment Risk Review Modernization Act (FIRRMA)

    The President signed the Foreign Investment Risk Review Modernization Act of 2018 (FIRRMA) into law on August 13, 2018 as part of the National Defense Authorization Act (NDAA) for Fiscal Year 2019 (H.R.5515). The law seeks to balance the gains of foreign investment against potential national security risks.

    A Harvard Law School Forum reports, "FIRRMA represents the most sweeping changes to the law governing the Committee on Foreign Investment in the United States (CFIUS) since the passage of the Foreign Investment and National Security Act of 2007 (FINSA)." And from Stephanie Zable on Lawfare:
    FIRRMA identifies several factors that Congress wants CFIUS to take into account when considering the national security risks posed by foreign investments.
    • Whether a transaction involves a country of special concern that has a strategic goal of acquiring technologies that would affect U.S. technological leadership in that area;
    • The national security effects of cumulative market share control by foreign persons;
    • Whether a foreign person involved in a transaction has a history of complying with U.S. law;

    On August 23, 2018, President Trump held a roundtable with lawmakers on FIRRMA. They discussed the importance of protecting U.S. intellectual property and technology from other countries, specifically China. The fairly brief video on C-SPAN is here.     On a related note, Michael Brown, former CEO of Symantec and co-author of a Pentagon study on China’s Technology Transfer Strategy, had recommended CFIUS reforms in his testimony before Congress on July, 19, 2018.

    DOE's New Office of Cybersecurity, Energy Security, and Emergency Response (CESER)

    On February 14, 2018, U.S. Secretary of Energy Rick Perry established a new office called the Office of Cybersecurity, Energy Security, and Emergency Response (CESER) to handle the Department of Energy's (DOE) security and emergency response operations. The office will oversee preparedness planning and emergency response for cyber threats, physical attacks, and natural disasters impacting the energy sector.

    DOE was designated the cybersecurity Sector-Specific Agency (SSA) for the energy sector, meaning that it is responsible for overseeing the security and resilience of this designated critical infrastructure. By creating CESER, the Department’s role will be strengthened.

    On August 28, 2018, Karen Evans was confirmed by the Senate to lead CESER as Assistant Secretary. Evans previously served as a top IT official, the position now known as the federal CIO, at the Office of Management and Budget under President George W. Bush. She also previously served as DOE's CIO. Most recently, she was the National Director of the U.S. Cyber Challenge, a program dedicated to building the U.S. cybersecurity workforce.

    In her new role, she testified before Congress for the hearing “DOE Modernization: The Office of Cybersecurity, Energy Security, and Emergency Response."

    NTIA on Software Component Transparency

    The National Telecommunications and Information Administration's (NTIA) first meeting on Software Component Transparency was held on July 19, 2018. From NTIA:
    NTIA’s next cybersecurity multistakeholder process will focus on Software Component Transparency. Participants will explore how manufacturers and vendors can communicate useful and actionable information about the third-party software components that comprise modern software and IoT devices, and how this data can be used by enterprises to foster better security decisions and practices.
    The next meeting is scheduled for November 6, 2018.

    NTIA posted the video and transcripts from their July 19, 2018 meeting as well as the slides from the perspective sharing presentations. The presenters included members from CERT/CC, Oracle Security Alerts Group, Siemens Healthineers, CA Veracode, PTC, and New York Presbyterian.

    Each presenter gave an 8-minute talk. The presentation from Josh Corman, the co-founder of the security group I Am The Calvary and the CSO of PTC, starts at 44:30. Here are his presentation slides. He discusses the Software Bill of Materials (SBOM) for medical devices.

    Supply Chain Vulnerabilities from China in U.S. Federal ICT - Report & Recommendations

    The U.S.-China Economic and Security Review Commission published a research report on supply chain vulnerabilities:
    Summary: The U.S.-China Economic and Security Review Commission released a report entitled Supply Chain Vulnerabilities from China in U.S. Federal Information and Communications Technology, prepared for the Commission by Interos Solutions, Inc. The report examines vulnerabilities in the U.S. government information and communications technology (ICT) supply chains posed by China, and makes recommendations for supply chain risk management.

    FICS' System to Detect Compromised Hardware

    The Florida Institute for Cybersecurity Research (FICS), the same group who developed the "Skim Reaper" (#SkimReaper) a device that can detect payment card skimmers, has engineered a semi-automated system to detect other kinds of subverted hardware like the servers purchased by Amazon, Apple, and others from Super Micro alleged to be compromised by a rice-sized Chinese micro-chip used to spy on the equipment.

    According to Mark M. Tehranipoor, the director of FICS and an IEEE Fellow, his institute's system uses "optical scans, microscopy, X-ray tomography, and artificial intelligence to compare a printed circuit board and its chips and components with the intended design."

    New ICT Supply Chain Task Force

    The Department of Homeland Security (DHS) held its first National Cybersecurity Summit on July 31, 2018. During the summit DHS's Christopher Krebs announced the creation of the Information Communications Technology Supply Chain Task Force and spoke with a panel of experts on what the task force should focus on for its first 90 days. The panelists included NSA's Rob Joyce, AT&T's John Donovan, and Palo Alto Network's Mark McLaughlin. The task force will be a part of the newly created DHS National Risk Management Center which launched with the task force in August. To add to that Congress is currently considering several pieces of legislation to protect the supply chain. One bill "Securing the Homeland Security Supply Chain Act of 2018" (HR 6430) was passed in the House on September 4, 2018 and has been sent to the Senate for debate.

    Supply Chain Risk Management and Testimony from Jennifer Bisceglie

    Jennifer Bisceglie testified for the Senate Homeland Security Committee hearing "Evolving Threats to the Homeland" on September 13, 2018. She specifically reviews supply chain risk management (SCRM) as it relates to information and communications technology (ICT), a security domain covered by her company Interos. 

    Her company recently supported the US China Economic and Security Review Commission with regards to their report on supply chain vulnerabilities from China "which outlines several recommendations, the most important being that the U.S. establish a “National Strategy for Supply Chain Risk Management (SCRM) in U.S. ICT” with supporting policies, so that the Nation’s security posture is forward-leaning vs reactive and based on incident response."

    She organizes her written testimony to address six key areas related to the report and to the topic of the hearing. Here are a few of the topics she addresses:

    1. A brief assessment of the emerging economic and national security risks from next generation connectivity and devices (particularly the IoT and 5G networks) for the U.S. with specific reference to the risks posed by other economies such as China, Russia and other sensitive countries. What additional risks, if any, does use of IT, standards, and/or equipment developed in sensitive countries pose to U.S. security? Are existing authorities and regulations adequate to address these challenges?
    Software supply chain attacks will become easier – and more prevalent - as developing technologies such as fifth generation (5G) mobile network technology and the IoT exponentially increase the avenues for attack.1 [,,,] Relevant to the Report, increasing IoT installations will expand the attack surface of federal ICT networks while decreasing the time required to breach them, yet to date, the time required to detect breaches is not decreasing. The responsibility of both the public and private sector in improving their approach to risk awareness and management in the commercial technology supply chain cannot be overstated.

    Reducing Gang Activity with a $50m a Year Law

    On June 18, 2018, President Trump signed the "Project Safe Neighborhoods Grant Program Authorization Act of 2018" into law (Act: H.R.3249, Public Law No: 115-185). It allocates $50m a year from 2019 to 2021 to the prevention and reduction of gang violence and crime. The law sponsored by Rep. Barbara Comstock (R-VA) was approved with 394 votes to 13 in the House, and by a unanimous voice vote in the Senate. From a WJLA article:
    "We have a large number of unaccompanied minors in the area and they are very vulnerable to these gangs recruiting them," he said. MS-13 habitually targets young immigrants, often forcing them into the gang through threats and intimidation. 
    "If I had my way, I'd spend the bulk of the money on intervention, prevention efforts," Lanham added, "because it's much cheaper to go that route and prevent them from joining the gangs than arrest your way out, which we're not going to do." [...] 
    "The amount of money should really assist in the coordination of local and federal law enforcement to target the worst of the worst using the best science we have," he said.

    Robotexts

    Here are tips from the FCC on handling robotexts:
    • Do not respond to unwanted texts from questionable sources. Several mobile service providers allow you to block the sender by forwarding unwanted texts to 7726 (or "SPAM"). Check with your provider about options.
    • Be careful about giving out your mobile phone number or any other personal information.
    • Read through commercial web forms and check for a privacy policy when submitting your mobile phone number to any customer website. You should be able to opt out of receiving texts – but you may have to check or uncheck a preselected box to do so.
    • Find out if any company you do business with has a policy that allows it to sell or share your information.

    You can file a complaint with the FCC if you receive a qualifying type of robotext, or you could simply share your experience with them. The FCC has resources, tips, and FAQs for handling such things as political calls and texts, spoofing, call blocking, etc.

    The FCC recently filed enforcement actions and fines against companies who were illegally spoofing telemarketing calls, one for $82m the other for $37.5m.
